General conditions of sale

Please read our general conditions of sale carefully before making a purchase on our website.

These conditions of sale govern the sale of scores uploaded to the website www.hdsb.eu by the company:

HDSB Music Publishing is a commercial name. The company is registered with the Crossroads Bank for Enterprises in Belgium under number BE0734.657.808 (Frederic Matagne Freelancer SRL).

The customer acknowledges having read these general conditions of sale at the time of placing an order.

The order implies full and unreserved acceptance of these general conditions of sale.

The general conditions of sale can be changed at any time by HDSB Music Publishing, subject to publication on the website www.hdsb.eu. The French version is the only recognised reference, even if translated versions are available on the website.

Downloaded scores

All scores purchased are available as a download directly from the website from the moment of purchase, as well as via a link sent by email. They can be downloaded without any particular limit (for example, the customer can download the score again if the file is lost). However, HDSB Music Publishing reserves the right to check on the number of downloads so as to combat illegal use. HDSB Music Publishing refuses any responsibility in case of error when the customer encodes the email address at the time of purchase. Any email address error can be corrected by simple request via the website.

Payment

Payment shall be made immediately at the time of purchase by means of a payment method indicated on the website www.hdsb.eu.

The customer has no right of withdrawal (supply of a digital content not provided on a material support).

Private use of downloaded scores

Buying scores by downloading them from the website www.hdsb.eu is the equivalent of acquiring an exclusive, non-transferable licence. Only a strictly private, personal and non-commercial use of the scores purchased is authorised. It is forbidden to copy, photocopy or transfer the scores by data processing, in whatsoever format, for commercial or any other purposes. HDSB Music Publishing implements a method for the marking of scores purchased in order to ensure compliance with this strictly private use.

Security and confidentiality

Particular attention is paid to our website security. HDSB Music Publishing retains no banking information. Transactions are effected directly by our partners using plugins installed on our website www.hdsb.eu.

HDSB Music Publishing pays particular attention to ensuring that your personal data are protected at all times, and takes every possible measure to ensure that this is the case. Only the following data are retained:

  • Online purchases

    • Invoicing address (street and house number, postcode, town, country)
    • Purchasing history (dates of purchase, titles purchased, payment method)
  • Contact form

You have the right to access, correct and contest any data relating to you.

Liability limits

The information contained in our catalogue on the product files may contain typographic or layout errors, despite the careful attention we pay to such matters. If you notice any errors we would greatly appreciate it if you could let us know so that we can make the necessary corrections.

We pay particular attention to the quality of the scores we publish. However, HDSB Music Publishing does not grant any price reductions or refund in the event of typographical or musical errors in the scores purchased. If you notice an error, we would greatly appreciate it if you could let us know. We undertake to correct this as soon as possible, but without necessarily replacing the purchased score with a corrected version.

The website www.hdsb.eu respects copyright. All works presented on this site are protected by copyright. Failing explicit mention, the use of works for purposes other than individual consultation is prohibited.

Visuals and excerpts of the content of the scores are the property of the rightful owners of the works. This data protection declaration explains, in accordance with the provisions of the general data protection regulation (GDPR), the information we collect, how we use the data and what decision options are open to you as a visitor to our website. 

Unless otherwise stated below, the provision of your personal data is not required by any law or contract and is not necessary in order to conclude a contract. You are not obliged to provide these data. Failure to provide data has no consequences.

Automatic data storage

Every time you visit our website, user data are sent to us or to our IT service provider by your web browser and stored in server log files. These stored data include information such as the name of the page consulted, date and time of access, IP address, the quantity of data transferred and the requesting provider. The data processing is on the basis of article 6, paragraph 1, point f of the data protection act, in our legitimate overriding interest of guaranteeing the effective functioning of our website and of improving our supply of services. 

If you contact us by email on your own initiative, we only collect your personal data (name, email address, message text) to the extent that you provide them. The data processing is for the purposes of processing and responding to your contact request. 

If the aim of the contact is to take precontractual measures (for example, advice on a potential purchase, offer preparation), or if it relates to a contract already concluded between you and us, this data processing is based on article 5, paragraph 1, point b of the data protection act

If the contact is made for other reasons, the data processing is effected on the basis of article 6, paragraph 1, point f of the data protection act, in our justified interest of processing and replying to your request. In this case, you are entitled to oppose at any time, for whatsoever reasons stemming from your particular circumstances, the processing of personal data concerning yourself on the basis of article 6, paragraph 1, point f of the data protection act.

We use your email address solely for the purposes of processing your request. Subsequently, your data will be deleted within the legal time limits for data retention, unless you have agreed to a supplementary processing and use. 

You can visit our website without giving any personal information. 

Online purchases

When you make an online purchase we only collect and process your personal data insofar as is necessary for effecting and processing your purchase and to respond to your requests. The supply of data is necessary to conclude a contract. The fact of failing to provide data means that no contract can be concluded. The processing is based on article 6, paragraph 1, point b of the data protection act, and is necessary for the execution of the contract with you. 

Your data will be communicated, for example, to the payment service providers and the IT service providers of your choice. In all cases we shall strictly comply with the legal requirements. This data transfer is kept to a minimum. 

Newsletter

When you register to receive our Newsletter we collect the following data:

  • Last name, first name
  • Email address

The data collected are used exclusively for the purposes of sending the newsletter. 

Cookies

Our website uses cookies. Cookies are small files that are stored in your web browser. Some of our website functions cannot be made available without cookies. For example, they are necessary for the browser to be recognised even after moving to another page, for example when an article is placed in a shopping cart. 

In addition to the cookies that are technically necessary, we use cookies that make it possible to analyse website behaviour so as to improve the quality and content of our website. When accessing our website, users are informed that cookies are being used for purposes of analysis and their consent is requested for the processing of personal data used in this context.

The legal basis for the use of technically necessary cookies to analyse personal data is article 6, paragraph 1, point a of the data protection act, if the user has consented. 

Cookies are stored on the user’s computer, which sends them to our website. As a user you have total control over the use of cookies. By modifying your web browser settings, you can deactivate or limit the sending of cookies. Cookies already stored can be deleted at any time. This can also be done automatically. If our website cookies are deactivated it may not be possible to make full use of all the website functions.

Data storage period

After the performance of the contract in full, the data are retained in accordance with the data storage periods laid down in law, in particular fiscal law, commercial law, copyright and publishing rights, and will be deleted on expiry of this period unless you have consented to an additional processing or use.  

Rights of the person concerned

If the legal conditions are met, you benefit from the following rights in accordance with articles 15 to 20 of the data protection act: right to information, correction, deletion and limiting of data processing and transmission. 

In addition, in accordance with article 21 paragraph 1 of the data protection act, you are entitled to oppose processing on the basis of article 6, paragraph 1, point f of the data protection act, as well as processing for direct marketing purposes. 

Right of appeal to the supervisory authority

By the terms of article 77 of the data protection act you have the right to complain to the supervisory authority if you consider that your personal data are being processed illegally. 

Right of opposition

If the processing of personal data as indicated here is based on our legitimate interest in accordance with article 6, paragraph 1, point f of the data protection act, you are entitled to oppose this processing at any time for reasons stemming from your particular situation, with effect for the future.  

The data processing in question ceases following opposition, unless we can demonstrate legitimate and important reasons justifying processing that take precedence over your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal rights. 

If the personal data are processed for direct marketing purposes, it is possible to oppose this processing at any time by notifying us of this desire. Once you have done so we will cease to process the data in question for direct marketing purposes.
